PHS/EHD has a contract <br /> 4 with California State Water Resources Control Board to conduct an underground storage tank corrective action program. Section <br /> 25299.37 (c) of the Health and Safety Code provides us the authority to require an investigation and cleanup of unauthorized <br /> releases. The above referenced site %%-as placed in the Local Oversight Program (LOP)'I in November 1989. <br /> PHS/EHD provided oversight in December 1989 during overexcavation of conta inated soil that was removed from the former <br /> tank location. The excavated soil was aerated on-site and the excavation backfilled with clean material. Soil sample results from <br /> the final limits of the excavation indicated a groundwater investigation was warranted. This office notified you in a letter dated <br /> April 9, 1990 to conduct a groundwarer investigation and submit a Preliminary,rReport by June 1, 1990. <br /> PHS/EHD has reviewed your file to determine if you are in compliance with corrective action orders and directives. Compliance <br /> with corrective action orders and directives is a requirement for reimbursement)of cleanup costs from the Cleanup Fund. <br /> 't t <br /> As a result of the review, it has been determined that you are not in compliance. The full extent of gasoline contaminated soil <br /> and groundwater has not been determined. In order to remediate the gasoline contamination; you must fully characterize its limits. <br /> For cases such as yours,the Cleanup fund is providing responsible parties with an opportunity to come into compliance. You <br /> must take positive concrete steps to come into compliance. <br /> i� <br /> Accordingly, you are directed to submit a workplan to this office within 90 days from the'date of this letter. The workplan shall <br /> include: 11 1 <br /> 1. A proposal to further define soil and groundwater contamination. <br /> I <br /> {I 2. A permit application for soil boring/monitoring wells <br /> 3.
