Before the <br /> Department may issue an Agreement, it must comply with the California Environmental <br /> Quality Act ("CEQA"). In this case, the Department, acting as a responsible agency, <br /> determined your project is exempt from CEQA and filed a notice of exemption ("NOE") <br /> on May 25, 2018. <br /> Under CEQA, filing a NOE starts a 35-day period within which a party may challenge <br /> the filing agency's approval of the project. You may begin your project before the 35-day <br /> period expires if you have obtained all necessary local, state, and federal permits or <br /> other authorizations.
