At the discretion of the Qualified Biologist, all trees or <br /> structures within the Biological Study Area capable of providing roosting habitat for <br /> bat species shall be surveyed by the Qualified Biologist 7 days prior to <br /> commencement of Project activities. If a lapse of 7 days or more in Project activity <br /> occurs surveys shall be conducted again. Cavities, culverts and crevices in <br /> hardened structures and tree crevices, exfoliating bark and bark fissures that could <br /> provide suitable potential nest or roost habitat for bats shall be checked using roof- <br /> prism binoculars supplemented as needed with a flashlight or spotlight. When <br /> possible, these features shall be examined by looking directly inside them. If <br /> hardened structures or trees have suitable habitat or bats are found, CDFW shall <br /> be consulted prior to commencement of Project activities to determine if additional <br /> survey requirements are needed, seasonal avoidance measures must be <br /> implemented or bat exclusion methods are necessary. CDFW reserves the right <br /> provide additional provisions to this Agreement designed to protect <br /> nesting/roosting bats. Upon determination of those methods, CDFW shall submit <br /> written avoidance and mitigation measures to the Permittee and those measures <br /> shall be considered part of this Agreement. <br /> 2.15 Containment Measures/ Construction Site BMPs. The barge, boat, drill rig, and <br /> containment drums will be regularly inspected for wear, leaks, and/or malfunction. <br /> Hazardous material leaks and spills will be attended to immediately. All activities <br /> performed in or near a river, stream, or lake shall have absorbent materials <br /> designated for spill containment and cleanup activities on-site for use in an <br /> accidental spill. The Permittee shall immediately notify the California Emergency <br /> Management Agency at 1-800-852-7550 and immediately initiate the cleanup <br /> activities. CDFW shall be notified by the Permittee and consulted regarding clean- <br /> up procedures. <br /> 2.16 Spill Prevention. A spill response plan shall be submitted to CDFW for approval in <br /> writing at least 7 days prior to the initiation of construction. A designated inspector <br /> familiar with the utilized construction equipment shall be onsite during all Project <br /> activities in order to monitor equipment operations, prevent waterway <br /> contamination and respond to equipment malfunctions. The barge, boat, heavy <br /> equipment shall be regularly inspected for wear, leaks, and/or malfunction. <br /> Hazardous material leaks and spills shall be attended to immediately as outlined in <br /> the Spill Prevention and Response Plan. Prior to entering the work site, all field <br /> personnel shall know the location of spill kits and trained in their appropriate use. <br /> 2.17 Spill Prevention Inspector. A designated inspector familiar with the utilized <br /> construction equipment shall be onsite during all project activities in order to <br /> monitor equipment operations, prevent waterway contamination, and respond to <br /> equipment malfunctions. <br /> 2.18 Hazardous Materials. Any hazardous or toxic materials that could be deleterious to <br /> aquatic life that could be washed into State waters or their tributaries shall be <br />
