Permittee shall comply with the NOAA Fisheries Water Drafting <br /> Specifications, accessible online at: <br /> http://www.westcoast.fisheries.noaa.gov/publications/hydropower/water drafting s <br /> pecification quidelines.pdf <br /> 2.26 Unauthorized Take. The Project area has been identified as an area that is <br /> inhabited by State and/or Federally-listed species. This Agreement does not <br /> authorize the take of any state or federal endangered or threatened species. <br /> Liability for any take or incidental take of such listed species remains the <br /> responsibility of Permittee for the duration of the Project. Any unauthorized take of <br /> such listed species may result in prosecution and nullification of the Agreement. <br /> 3. Reporting Measures <br /> Permittee shall meet each reporting requirement described below. <br /> 3.1 Survey Reports. Survey results for nesting birds shall be submitted to CDFW a <br /> minimum of 5 days prior to the start of work and included in the Final <br /> Construction Report noted in measure 3.2 of this Agreement. <br /> 3.2 Final Construction Report. A Final Construction Report shall be submitted within <br /> 60 days of Project completion and shall document the results of pre-construction <br /> and clearance surveys, document the construction schedule of the Project and <br /> include an analysis of the success and failure of avoidance and minimization <br /> measures contained in this Agreement. The Final Construction Report shall also <br /> contain the final Log of Test Boring report and Photographic documentation of <br /> work as noted in measure 3.3 of this Agreement. <br /> 3.3 Photographic Documentation of Work. Within 60 days of Project completion the <br /> proponent shall provide four vantage points of the Project to include all Project <br /> elements from a before, during and after construction timeframe. The before, <br /> during and after photos shall be from the same vantage point and submitted with a <br /> reference key describing the location of the photo, direction of the view and <br /> whether the photo is pre or post construction. The photos shall be included in the <br /> Final Construction Report noted in measure 3.1 of this Agreement. <br /> 3.4 Notification to the California Natural Diversity Database (CNDDB). If any special <br /> status species are detected during project surveys or on or around the project site <br /> during project activities, Permittee shall submit CNDDB Field Survey Forms to <br /> CDFW in the manner described at the CNDDB website <br /> (http://www.wildlife.ca.qov/biogeodata/cnddb/submittinq data to cnddb.asp) within <br /> 14 working days of the sightings. Copies of such submittals shall also be submitted <br /> to the CDFW regional office as specified below. <br />
