June 2, 2011 <br />Page 4 of 5 <br />Response: As indicated in our response to item #8 above there are no on-going <br />activities where hazardous waste is routinely generated at the facility. Estes has <br />arrangements with outside contractors to provide the necessary response in case a leak <br />or spill of hazardous materials occurs on the site (i.e. spill of diesel fuel from a truck <br />tank). In those cases, Estes relies upon the trained contractors to handle, and dispose of <br />hazardous materials. That may include arranging for a temporary EPA number to <br />dispose of the waste if needed. Employees at the terminal do not handle any hazardous <br />waste materials and therefore no hazardous materials training is required or performed <br />at this terminal. <br />60 & 63. Inspector: Copies of hazardous waste disposal records 2008 thru 2011 were <br />not found on the site. Hazardous waste generators shell retain copies of all manifest <br />signed off by the disposal facility and all receipts used in a consolidated manifest <br />procedure on site for three years and have them readily available for review. <br />Immediately locate a copy of all manifest and receipts for the last three years, maintain <br />them on site and submit to EHD by June 28, 2011. Note. According to test results for <br />secondary containment done September 22, 2010 at this facility, 200 gallons of <br />contaminated test water was put in drums and left on site. This waste stream was not <br />found on-site at the time of inspection. <br />Response: Attached is a copy of the receipt for pick-up and disposal of the 200 gallons <br />of water that was utilized during the testing of the lines on the UST system. The pick up <br />of this material was arranged by Stockton Service Station and completed 5 days after <br />the UST testing was performed. There are no other manifest records available to provide <br />as there has been no hazardous waste removed from the site in the last three years. <br />79: Inspector: UW lamp storage at the time of inspection. 23-4ft used lamps were seen <br />leaning against the wall in the storage shed. Facilities must store UW lamps in a closed <br />container and in a manner that prevents breakage and releases to the environment and <br />immediately clean and containerize and broken lamps or releases to the environment. <br />Immediately store UW lamps. <br />Response: All lamps that are leaning against the wall in the shed will be repackaged <br />into their original container and place in a manner in the shed to prevent breakage. Any <br />broken lamps will be cleaned up immediately and contained into an approved container. <br />83. Inspector: Failed to label UW to identity type of waste. At time of inspection UW <br />lamps were no labeled adequately. Universal containers must be labeled at a minimum <br />"Universal Waste" and the type of waste being stored. Immediately properly label <br />container of UW. <br />Response: All containers of UW lamps will be immediately labeled with a sign indicating <br />"Universal Waste" —"Florescent lamps". <br />84. Inspector: Store UW on site .for more than 1 year. At time of inspection in could not <br />be demonstrated how long universal waste bulbs had been stored.
