STOCKTON <br />Date: <br />May 26, 2017 <br />SUMMARY OF VIOLATIONS <br />(CLASS 1, CLASS II, or MINOR- Notice to Comply) <br />Item # <br />Remarks <br />106 <br />CCR 66262.34(d)(2) Failed to train employees on waste handling and emergency procedures. <br />At the time of inspection, it could not be demonstrated (not necessarily documented) that employees who handle <br />hazardous waste were properly trained. Mr. Mozingo indicated that no hazardous waste specific training is being <br />provided. The generator must ensure that all employees who handle hazardous waste are thoroughly familiar with <br />proper waste handling and emergency procedures. Provide proof of training to the EHD for employees whose <br />responsibilities include hazardous waste. (EHD's handout for free CUPA classes was provided with this inspection <br />report) <br />This is a Class II violation. <br />301 <br />CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. <br />Two 55 -gallon containers of new lubricating oil were observed in a hazardous material storage area, oily liquid was <br />observed on the top of these drums. Facilities shall be maintained and operated to minimize the possibility of a fire, <br />explosion, or release of hazardous waste to air, soil, or surface water which could threaten human health or the <br />environment. Immediately clean all free oil from the top of the containers, and manage according to Title 22 <br />hazardous waste regulations. Submit a statement and supporting documentation explaining how this waste was <br />managed. <br />This is a repeat violation, Class II. <br />303 <br />CCR 66262.34(d)(2) Failed to maintain all communication or alarm systems, spill control, or decontamination <br />equipment. <br />Oily dark liquid was observed inside the secondary containment utilized for storage of two red 55 -gallon containers <br />of new lubricating oil. All facility communications or alarm systems, fire protection equipment, spill control <br />equipment, and decontamination equipment, where required, shall be tested and maintained as necessary to assure <br />its proper operation in time of emergency. Immediately begin this practice. Submit proof of correction to the EHD. <br />This is a repeat violation, Class Il. <br />406 <br />CCR 66261.7 Contaminated container not marked with date emptied or managed within one year of being emptied. <br />Five 55 -gallon empty containers (located in the outdoor area, south of the main site building structure) which <br />previously held hazardous materials were not labeled as appropriate. Containers larger than five gallons that <br />previously held a hazardous material shall be marked with the date they were emptied and managed within one year <br />of being emptied. These containers were labeled as appropriate at the time of inspection. <br />This was corrected on site. <br />This is a Class II violation. <br />Overall Inspection Comments: <br />Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br />documenting the corrective actions that have been or will be taken for each violation, and any supporting <br />paperwork, by 5-26-2017. <br />Mr. Jimmy Mozingo indicated that all vehicle maintenance is done by the outside company Interstate, out of <br />FAGD03695 PR0522563 SCO01 05/26/2017 <br />EHD 22-01 Rev. 09/22/16 Page 4 of 5 Small Quantity Hazardous Waste Generator OR <br />
