Aurora St., Stockton Program: HW <br /> SUMMARY OF VIOLATIONS <br /> CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> 701, A 55 gallon black steel drum of spent absorbent was observed in the hazardous waste storage <br /> area with no label. No disposal records were available on site for the past three years. According to the <br /> facility contact, it has probably not been hauled in that time. Facilities who generate less than 1000 kg of <br /> hazardous waste per month and do not exceed 6000 kg of waste stored on site at any time may store <br /> waste on site up to 180 days. Immediately contact a licensed hazardous waste hauler to dispose of this <br /> waste under manifest and submit a copy of the manifest to the EHD by December 16, 2012. <br /> REPEAT VIOLATION <br /> Complete and submit a copy of the Return to Compliance Certification to the EHD by December 16, <br /> 2012 along with a statement documenting the corrective actions that have been or will be taken for each <br /> violation and any supporting paperwork. <br /> Notes: (corrected on site) <br /> - Metal fines generated from metal grinding are being recycled as scrap metal without first determining <br /> particle size or hazardous properties. Any person who generates a waste shall determine if the waste is <br /> a hazardous waste. Particles 100 microns or smaller must be handled as hazardous waste if the metal <br /> is determined to be a hazardous waste. Ms. Morga stated at the time of inspection that the metal fines <br /> will be handled as hazardous waste from now on and will be disposed of by Evergreen Environmental. <br /> - A 55 gallon blue steel drum and a 15 gallon tan steel drum which previously held used oil were <br /> observed without empty labeling in the hazardous waste storage area. Containers larger than five <br /> gallons that previously held a hazardous material shall be marked as empty with the date they were <br /> emptied and managed within one year of being emptied. The drums were labeled at the time of <br /> inspection. <br /> - A 55 gallon black steel drum of drained used oil and fuel filters was observed without an accumulation <br /> start date. Used filters must be stored in a closed, rainproof container, labeled as "drained used oil and <br /> gasoline filters," and marked with an accumulation start date.
