Carr <br /> Director of Operations <br /> IVAX Industries <br /> 1140 East 103rd Street <br /> Chicago, Illinois 60628 <br /> INFORMATION REQUEST FOR BEAULIEU CHEMICAL, 400 SOUTH AURORA <br /> STREET, STOCKTON, CALIFORNIA, 95203 <br /> Dear Mr. Carr: <br /> The Department of Toxic Substances Control (Department) has <br /> received information that the above-named facility, Beaulieu <br /> Chemical, owned and/or operated by IVAX, has stored and/or <br /> handled hazardous materials as defined by the California Health <br /> and Safety Code (HSC) , Section 25316. <br /> Specifically, the reported spill of concentrated sulfuric <br /> acid in 1982 , and the haphazard storage of chemicals and drums at <br /> the Beaulieu Chemical facility have led the Department to suspect <br /> possible releases of hazardous materials to the environment while <br /> Beaulieu Chemical operated at 400 South Aurora Street in <br /> Stockton. <br /> As part of the investigation, the Department is requesting <br /> historical information from you, a representative of IVAX, and <br /> the former Beaulieu Chemical. Under Section 25358 . 1 of the HSC, <br /> any duly designated officer, employee, or representative of the <br /> State of California may require persons subject to Chapter 6.8 of <br /> the HSC to furnish information necessary for the Department to <br /> determine the appropriate response to a release of hazardous <br /> substances or wastes. The information requested is extensively <br /> described in the attachment to this letter pursuant to Chapter <br /> 6. 8 of the HSC. <br /> Compliance with the site specific request for information <br /> set forth in the attachment is mandatory. Failure to respond <br /> fully and truthfully to this request within forty five (45) days <br /> of receipt of this letter, or to adequately justify such failure <br /> to respond, may result in enforcement action (enforcement action <br /> may include, but is not limited to civil penalties, including <br /> fines of up to $25, 000. 00 per day per violation) by the <br /> Department pursuant to Chapter 6.8 of the HSC (Section 25367) . <br /> �L <br /> 0 � <br /> R� <br />
