The following is an itemized list of hazardous waste violations that have not been <br />addressed for A & D AUTO BODY as of November 17, 2015. <br />Open violations from May 28, 2015 inspection <br />Violation #102 - Failed to determine if a waste is a hazardous waste or retain waste analysis on site for 3 <br />years. <br />Metal fines and paint dust generated from sanding vehicles in preparation for painting are being allowed to accumula <br />inside the shop and outside the shop on the parking lot without first determining metal particle size or hazardous <br />properties of the metal and paint dust waste. Any person who generates a waste shall determine if the waste is a <br />hazardous waste. Immediately stop allowing paint and metal fines waste to leave the auto body shop, make a <br />hazardous waste determination for these wastes, and manage it according to Title 22 hazardous waste regulations. <br />Metal particles 100 microns or smaller must be handled as hazardous waste if the metal is determined to be a <br />hazardous waste. Submit a statement and supporting documentation explaining how these wastes were managed. <br />Violation #117 - Failed to report program data electronically. <br />A submission to the California Electronic Reporting System (CERS) for the hazardous waste program has not been <br />made. Beginning January 1, 2013, all businesses are required to submit all new (or any changes to existing) <br />hazardous waste information online to the CERS at http://cers.calepa.ca.gov. Be sure to include your hazardous <br />waste activity in the Businesses Activities section in CERS in addition to any other relevant activities and required <br />fields. <br />Violation #301 - Facility not maintained to minimize the release of a hazardous waste. <br />Various vehicles related to this business are parked in the lot outside and have leaked oil. Some of these oil leaks <br />have absorbent on them. Theses oil leaks and contaminated absorbent have been left on the lot. Facilities shall be <br />maintained and operated to minimize the possibility of a fire, explosion, or release of hazardous waste to air, soil, or <br />surface water which could threaten human health or the environment. Immediately clean up the oil leaks and <br />contaminated absorbent, and manage according to Title 22 hazardous waste regulations. Submit a statement and <br />supporting documentation explaining how this waste was managed. <br />Violation #403 - Failed to keep hazardous waste containers closed except when adding or removing <br />hazardous waste. <br />Inside the shop is a five gallon container with a hazardous waste label which the owner confirmed is waste paint. <br />Inside the shop is a blue 55 gallon drum of hazardous waste oil. The 5 gallon container opening was covered but not <br />closed. The 55 gallon drum opening was left open. All hazardous waste containers shall be closed at all times excep <br />when adding or removing waste. Immediately close these containers and ensure all hazardous waste containers are <br />closed when not adding or removing waste. <br />Violation #601 - Stored hazardous waste onsite greater than 180 days. <br />Inside the shop is a five gallon container with a hazardous waste label which the owner confirmed is waste paint. <br />Inside the shop is a blue 55 gallon drum of hazardous waste oil. These containers both have an accumulation start <br />date of November 2013. These wastes have been on site longer than 180 days. Facilities who generate less than <br />1000 kg of hazardous waste per month and do not exceed 6000 kg of waste stored on site at any time may store <br />waste on site up to 180 days. Immediately contact a licensed hazardous waste hauler to dispose of this waste under <br />manifest and submit a copy of the manifest to the EHD. <br />Page 1 of 2 <br />
