i <br /> 1 1. 4 Exhibits. All Exhibits attached to this Order are <br /> 2 incorporated herein by this reference. Those Exhibits are <br /> 3 identified as follows: Attachment A (Site Location Map) ; and <br /> 4 Attachment B (Site Map) . <br /> 5 1. 5 . Purpose. In entering into this Order, it is the objective <br /> 6 of the parties to ensure that the nature and extent of any releases <br /> 7 or threatened releases of a hazardous substance to the air, soil, <br /> 8 surface water and ground water at or from the Site are thoroughly <br /> 9 investigated and that appropriate remedial actions are taken. <br /> 10 1. 6 . Investigation of Area III . In entering into this Order, <br /> 11 the Parties further agree that PG&E shall thoroughly investigate <br /> 12 Area III (as shown on Attachment B) which was previously operated as <br /> 13 part of the original gas manufacturing facility by PG&E. If <br /> 14 necessary, the Department shall use its legal authority to assist <br /> 15 PG&E in obtaining access to Area III to perform such investigation. <br /> 16 As with the other Site areas investigated under this Order, PG&E <br /> 17 shall mitigate, as appropriate, any contaminants existing on Area <br /> 18 III as identified in the Remedial Investigation to the extent such <br /> 19 contaminants were released as a result of PG&E' s operations on the <br /> 20 Site including operation of the historic gas manufacturing facility. <br /> 21 PG&E shall not be responsible for the mitigation of contaminants <br /> 22 existing on Area III and caused by Area III 's current owner and/or <br /> 23otherthird parties. <br /> 24 1.7 Denial of Liability. PG&E ' s consent to issuance of this <br /> 25 Order shall not be construed as an admission of any liability for, <br /> 261 or arising from, the conditions at the Site, except for the <br /> 27 obligations to which it has committed itself herein.
