PRA06-038
April 28, 2006
Page 2
Ms. Barri
SUBJECT: LLNL Site 300 Response to the Violations Identified in the DTSC
March 20, 2006 Inspection Report, EPA ID. No. CA2890090002
Lawrence Livermore National Laboratory, Site 300
2. Transporting the waste by an LLNL hazardous waste transporter -registered
vehicle to Clean Harbors.
3. Ensuring the waste was accepted by a TSDF, in compliance with the "cradle to
grave" tenet of RCRA.
Moreover, human health and the environment were never compromised as a result of
this administrative violation. The waste was never out of the control of LLNL or Safety
Kleen personnel, and it was properly disposed at the Clean Harbors facility.
Prior to receiving the violation, LLNL determined that all future wastes of this type
would be shipped to Clean Harbors, thereby avoiding future waste acceptance issues
by Safety Kleen. After receiving the violation, LLNL's shipping personnel reviewed the
inspection report, Health and Safety Codes 25160.6 (a)(1) and 25189 (a), DTSC Fact
Sheet "Rejected Shipments of Hazardous Waste," manifests #23440668 and 23440682
and this corrective action response letter.
LLNL respectfully requests DTSC to return LLNL Site 300 to compliance by accepting
the violation corrective actions described above.
Please contact Patrick Epperson, Deputy Division Leader, Radioactive and Hazardous
Waste Management (RHWM), at (925) 422-6920 if you have any questions regarding
this response.
Sincerely,
Albert L.
