Box 808, L — 871 <br />Livermore, California 94550 <br />Dear Mr. Lane: <br />RECEIVED <br />APR 0 5 2006 <br />SITE 300 <br />ADMINISTPUTION <br />Arnold Schwarzenegger <br />Governor <br />On June 16, 2005, the California Environmental Protection Agency, Department of <br />Toxic Substances Control (Department), conducted an inspection of Lawrence <br />Livermore National Laboratory, located at Site 300, Tracy, California 94550. The <br />enclosed report describes the findings of this inspection, including all violations and any <br />actions that should be taken by the facility to correct the violations. <br />The following violations described in the inspection report were found subsequent to the <br />issuance of the June 21, 2005, Summary of Observations: <br />Class II Violations: <br />1. LLNL Site 300 violated Health and Safety Code section 25160.6 (a) (1) in that on or <br />about February 10, 2005, the facility failed to use the original manifest to transport the <br />rejected load to either the generator or an alternate facility. designated by the generator. <br />2- LLNL Site 300 violated Health and Safety Code section 25189 (a) in that on or about <br />February 10, 2005, LLNL site 300 made, a false representation on hazardous waste <br />manifest number 23440682. <br />You are required by section 25185(c)(3) of the Health and Safety Code to submit a <br />written response to the Department within 7 days describing the corrective actions that <br />you have taken or propose to take to bring your facility into compliance. If you dispute <br />any of the violations, you should explain your disagreement in this written response. <br />The issuance of this letter does not preclude the Department from taking administrative, <br />civil, or criminal action as a result of the violations noted in the report. <br />® Printed on Recycled Paper <br />
