Failed to determine if waste is a hazardous waste. Facility performs brake grinding. According to an <br /> employee, the metal grinds are currently being thrown into the garbage. Brake grinding smaller than <br /> <100 microns are a hazardous waste. A person who generates a waste shall determine if that waste is a <br /> hazardous waste in accordance to California Code of Regulations, Title 22, Hazardous Waste <br /> Regulations. Correct by determining if the metal grinds are a hazardous waste and dispose of it <br /> accordingly OR handle the metal grinds as hazardous waste. <br /> # 8. Manage hazardous waste without an active EPA ID number. Currently, according to Department of <br /> Toxic Substance Control, CAL000010248 is an inactive EPA ID number. Correct by reactivating this <br /> EPA ID number on the provided DTSC Form 1358 and submit a copy to SJC EHD by 10/20/10. <br /> # 20 & 27 & 50. Failed to completely label containers of hazardous waste, keep the container closed <br /> unless adding or removing waste and stored onsite greater than 180 days. An open 5 gallon container <br /> of waste absorbent was not labeled with the required information has been store at facility >180 days. All <br /> containers of hazardous waste must be identified with the minimum following information: words <br /> "Hazardous Waste", generator's name & address, contents, physical state, hazardous property and an <br /> initial start accumulation date. Hazardous waste container must be kept close at all times unless adding <br /> or removing waste to avoid spillage into the environment. Hazardous waste can be store onsite for up to <br /> 180 days = 6 months from the date of start accumulation. Correct by properly labeling the container with <br /> the following above information with the provided label, have a lid to keep the contents securely <br /> contained and provide a copy of the hazardous waste disposal receipt for the waste absorbent to SJC <br /> EHD within 30 days (10/20/10). <br /> # 60 & 63. Failed to keep signed copy of the Uniformed Hazardous Waste Manifest and consolidated <br /> manifest for 3 years. Facility was only able to provide current 2010 and less than half of 2009 disposal <br /> records. Generators shall keep copy of each manifest signed and received by the hazardous waste <br /> transporter onsite for a minimum of 3 years.
