RECEIVED <br /> The following is an itemized list of hazardous waste violations that have not b2ff, 18 2015 <br /> addressed for AMERICAN TIRE & TRUCK REPAIR as of February 17, 201 <br /> ENv►RnNMENTAL <br /> Open violations from October 15, 2014 Inspection !'ca1T1L1 );;D1RTAAFNT <br /> Violation#102-Failed to determine if a waste is a hazardous waste or retain waste analysis on site for 3 <br /> years. <br /> According to Mr. Bassi, small oil and diesel spills are cleaned up "mostly with napkins"which they"throw away." <br /> Dark soil was observed swept into a small pile in the yard behind the shop, Mr. Bassi stated he did not know what it <br /> came from- No hazardous waste determination has been made for the soil or the absorbent. Any person who <br /> generates a waste shall determine if the waste is a hazardous waste. Immediately stop disposal of absorbent <br /> materials as non-hazardous, make a hazardous waste determination for the absorbent waste, and manage it <br /> according the Title 22 hazardous waste regulations. Submit a statement and supporting documentation explaining <br /> how this waste was managed. This is a minor violation. <br /> Violation#103 -No modified contingency plan. <br /> An emergency coordinator and modified contingency plan information is lacking. There must be at least one <br /> emergency coordinator on site or on call to coordinate emergency response measures, and the following information <br /> must be posted by a phone: the name and phone number of the emergency coordinator; location of fire extinguisher! <br /> spill control equipment, and if present, fire alarm; and the phone number of the fire department, unless the facility ha: <br /> a direct alarm. Immediately appoint an emergency coordinator and post the required information by a phone. A forn <br /> is provided that can be used for this purpose. This is a minor violation. <br /> Violation #109 -Failed to keep signed copy of manifests from the designated facility for three years, <br /> Manifest number 009208772JJK(1/30/12) was not found on site. Copies of uniform manifests for the disposal of <br /> hazardous waste for the last three years were not found on site. Hazardous waste generators shall retain copies of r <br /> manifests for three years or until a copy signed off by the destination facility is received. The signed off copy shall be <br /> retained and made readily available for review for three years. If the generator did not receive a copy of the manifest <br /> with the handwritten signature of the owner or operator of the facility to which the generators waste was submitted <br /> within 60 days of the date the waste was accepted by the initial transporter, the generator shall submit a legible copy <br /> of the missing manifest, with some indication that the generator has not received confirmation of delivery. This <br /> information shall be submitted to; <br /> DTSC Report Repository <br /> Generator Information Services Section <br /> P.O. Box 806 <br /> Sacramento, CA 95812-0806 <br /> Immediately locate a copy of the missing manifests or prepare and submit the required information to DTSC. Submi- <br /> to the EHD a copy of the signed off copy of the manifests or a copy of the information submitted to DTSC.
