IV. GENERAL BACKGROUND: <br /> On April 28, 1987, complaint #87-747 was received alleging untreated hazardous waste water from Circuit <br /> Works was entering into the city sewer system,and drums of hazardous waste were remaining onsite for more <br /> than 90 days. <br /> On April 29, 1987, a site inspection of Circuit Works was conducted in response to complaint #87-0747 <br /> regarding illegal discharge of hazardous waste water into the city sewer and illegal storage of hazardous <br /> waste. This inspection was performed by the City of Stockton Municipal Utilities District, State <br /> Department of Health Services (DHS), and Pubic Health Services-Environmental Health Division. <br /> On June 26, 1987, DHS sent Circuit Works a Report of Violation and Schedule of Correction for the <br /> inspection conducted on April 29, 1987. Six hazardous waste violations were described: <br /> 1. Storing hazardous waste in excess of 90 days and without proper labeling. <br /> 2. Treating hazardous waste without a hazardous waste permit or variance. <br /> 3. Treating and disposing of hazardous waste to the sewer without an National Pollutant Discharge <br /> Elimination System (NPDES) permit. <br /> 4. Not completing a biennial report, and submitting this report to the Department of Health <br /> Services. <br /> 5. Lack of a training program for all employees who are involved with hazardous waste management. <br /> 6. Storing hazardous waste in uncovered drums. <br /> On February 2, 1989, the City of Stockton Municipal Utilities District sent a complaint to the San Joaquin <br /> County District Attorney's Office regarding corrosives discharged into the sewer system by Circuit Works <br /> on December 20, 1988. This letter requested the County District Attorney's office to take legal action <br /> against Circuit Works, and for Circuit Works to complete the following: 1) A spill prevention plan, and 2) <br /> Submit a compliance schedule to the City of Stockton, regarding waste discharge violations. <br /> On February 8, 1989, Lisa Brown, Deputy District Attorney of San Joaquin County wrote a letter to Jerry <br /> Ruiz, Attorney, representing Circuit Works. This letter addressed changes to an injunction on waste <br /> discharge; additional waste discharge violations documented during the corrosive spill of December 20, <br /> 1988. <br /> On March 16, 1989, consent was established on a final judgement against Circuit Works held in the <br /> Superior Court of San Joaquin County. The final judgement addressed the following: <br /> 1. The illegal discharge of hazardous waste. <br /> 2. The monitoring of waste water discharged to the sanitary sewer from the pretreatment system. <br /> 3. The stoppage of waste discharge to the sanitary sewer upon discovery of a substantial release of <br /> contaminated waste water. <br /> 4. The City of Stockton sewer system enforceable discharge requirements. <br /> V. GENERAL DESCRIPTION OF FACILITY: <br /> The Circuit Works facility manufactures printed circuit boards for a variety of companies in the electronics <br /> industry. Circuit Works specializes in customized circuits with multi-laminated boards, commonly used in <br /> the computer industry. <br /> 2 <br />
