9 <br />3.10.2. To the Project Proponent: <br />r <br />Mr. Hal Monroe <br />Property Management Experts <br />Court Appointed Receiver's Representative <br />200 W. Harding Way <br />Stockton, CA 95204-5607 <br />3.11. Communications. Any of DTSC's approvals and <br />decisions made regarding documents and communications will be <br />communicated to Project Proponent in writing by the Branch Chief, <br />Site Mitigation Branch, DTSC or his/her designee. No informal <br />advice, guidance, or suggestions or comments by DTSC regarding <br />reports, plans, specifications, schedules or any other writings <br />by DTSC shall be construed to relieve Project Proponent of the <br />obligation to obtain such formal approvals as may be required. <br />3.11.1. DTSC shall be allowed access to the Site described <br />in this Agreement whenever DTSC determines that access is <br />necessary to protect the public health and safety or the <br />environment. <br />3.11.2. When requested by DTSC, Project Proponent shall <br />make available to DTSC, and shall provide copies of, all data and <br />information concerning contamination at the Site, including <br />technical records and contractual documents, sampling and <br />monitoring information and photographs and maps, whether or not <br />such data and information was developed pursuant to this <br />Agreement. <br />3.12. Sampling, Data and Document Availability. Project <br />Proponent shall submit to DTSC all sampling data and related <br />documents when available to the Project Proponent. <br />3.13 Notification of Field Activities. Project Proponent <br />shall inform DTSC at least seven days in advance of all field <br />sampling and other field activities and shall allow DTSC and its <br />authorized representatives to take duplicates of any samples <br />collected by the Project Proponent pursuant to this Agreement. <br />3.14 Preservation of Documentation. Project Proponent <br />shall maintain a central depository of the data, reports, and <br />other documents prepared pursuant to this Agreement. All such <br />7 <br />
