He <br />stated that there is probably 200-300 gallons of used oil in the tank. Facilities who generate less than 1000 kg of <br />hazardous waste per month and do not exceed 6000 kg of waste stored on site at any time may store waste on site <br />up to 180 days. Immediately contact a licensed hazardous waste hauler to dispose of this waste under manifest and <br />submit a copy of the manifest to the EHD. <br />This is a Class II violation. <br />605 <br />CCR 66262.34(f) Failed to completely label containers or tanks of hazardous waste. <br />The used oil tank was observed marked with the words "waste oil," but with no other labeling. All hazardous waste <br />tanks shall be marked with the words "Hazardous Waste" and the accumulation start date. Immediately ensure that <br />all hazardous waste tanks are marked with the required information. <br />This is a minor violation. <br />Overall Inspection Comments: <br />Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br />documenting the corrective actions that have been or will be taken for each violation, and any supporting <br />paperwork, within 30 days of receiving this report. <br />Note: According to the owner, Mr. Floyd Barnes, the business does not generate hazardous waste. The previous <br />business was Barnes Trucking, with the same owner. The current business, Play and Park, is for parking and <br />storage of boats, cars, trucks, RVs, etc. According to Mr. Barnes, he does not allow the customers to change any <br />oils or other fluids on his property. The shop from Barnes Trucking is still in the back of the property with some <br />equipment and chemical storage. Mr. Barnes stated that these are kept and being used for his own personal use <br />on his personal vehicles, which are the only ones stored in the shop - a pickup truck, a RV trailer, a forklift (used to <br />move his personal boats around), and five boats were observed. According to Mr. Barnes, he changes oil <br />approximately once a year in the forklift and the pickup truck, and then places the used oil in the 550 gallon used of <br />tank left over from the trucking company. This used oil is not being disposed of or managed correctly. <br />Please be aware as of January 1, 2013, all businesses are required to submit all hazardous materials information <br />online to the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov.
