Sent via Certified Mail. <br /> Minor Notice-to-Comply Violations: # 7, 17, 23, 30, 83, 84, 85 Class II: # 52 <br /> 7. Failed to determine if waste is a hazardous waste. A 5 gallon and one gallon buckets of paint is found <br /> stored outdoors behind the propane-fueled emergency generator shed is determine to be of no use per <br /> the janitor. When absorbent is used to clean up spilled oil, the oily-absorbent is thrown away per the <br /> auto technician. Any person who generates a waste shall determine if the waste is a hazardous waste. <br /> Immediately stop disposing any waste into the garbage, make a hazardous waste determination for the <br /> brake fines, and manage it according the Title 22 hazardous waste regulations. Waste paint and oily- <br /> absorbent may have hazardous waste characteristic of flammability or toxicity. Submit a statement and <br /> supporting documentation explaining how this waste was managed by 06/20/11. If being disposed as <br /> hazardous waste, save the disposal receipt onsite for a minimum of 3 years. <br /> 17. Failed to maintain aisle space. In the tire storage area, there are several empty cardboard boxes <br /> stored in front of unknown chemicals and spill control equipment, ie mop bucket, mop. There is limited <br /> access to find out the contents of these chemicals. The operator shall maintain aisle space to allow the <br /> unobstructed movement of personnel, fire protection equipment, spill control equipment, and <br /> decontamination equipment to any area of the facility operation in an emergency. Correct immediately <br /> by maintaining aisle space to provide access and walkway. <br /> 23. Failed to close container of drained used oil filters and mark with a start accumulation date. One <br /> drum of used oil filter is lacking a start accumulation date. Lifting the lid of the drum, it was found to <br /> contain approximately 2 inches of oily water along with oil filters. Per auto technician, it lid was off during <br /> the rainy weather. Used oil filters must be stored in a closed, rainproof container, labeled as "drained <br /> used oil filters," and marked with an accumulation start date. Immediately remove the oily-water from <br /> the drum of oil filters into a proper hazardous waste container and ensure that all used oil filters are <br /> managed in this way. <br /> 30. Failed to manage hazardous waste containers larger than 5 gallons. One blue metal 55 gallon drum <br /> that once stored motor oil found stored behind the emergency generator building was presumed empty <br /> but contains rainy liquid contaminated with motor oil. It lacked a cover for the bung hole. A container that <br /> is empty must be marked as "Empty" and with date of being emptied. It shall be managed within one <br /> year of being emptied. Correct by properly disposing the oily-water into a proper hazardous waste <br /> container. Mark this drum "Empty" and date. Manage this drum within 1 year or have the drum recycled. <br /> ALL EHD STAFF TIME ASSOCIATED WITH FAILING TO COMPLY BY THE ABOVE NOTED DATES WILL BE BILLED AT THE CURRENT HOURLY RATE($122). <br /> THIS FACILITY IS SUBJECT TO REINSPECTION AT ANY TIME AT EHD'S CURRENT HOURLY RATE. <br /> EHD I pedor: Received By: Title: <br /> MG <br /> EHD23-02-003 Rev08110/10 CONTINUATION FORM <br />
