Any other treatment of <br /> wastes containing silver or silver compounds that are RCRA hazardous <br /> wastes is subject to all of the applicable requirements of this <br /> chapter. <br /> (d) The department shall amend its regulations, as necessary, to <br /> conform to this section. Until the department amends these <br /> regulations, the applicable regulations adopted by the Environmental <br /> Protection Agency pursuant to the federal act pertaining to the <br /> regulation of wastes containing silver or silver compounds, which are) <br /> regulated as RCRA hazardous wastes solely due to the presence of <br /> silver in the waste, shall be deemed to be the regulations of the <br /> department, except as otherwise provided in subdivision (c) . <br /> (e) This section shall not be construed to limit or abridge the <br /> powers or duties granted to any state or local agency pursuant to any <br /> law, other than this chapter, to regulate wastes containing silver <br /> or silver compounds. <br /> 25143.14 . (a) Except as otherwise provided in subdivisions (c) and <br /> (d) , residues that are removed from equipment for the purpose of <br /> cleaning the equipment for continued use are subject to regulation <br /> under this chapter only after the residues have been removed from the <br /> equipment. <br /> (b) Except as otherwise provided in subdivisions (c) and (d) , the <br /> act of removing residues from equipment for the purpose of cleaning <br /> the equipment for continued use constitutes generation, and not <br /> treatment, of a hazardous waste. <br /> (c) Subdivisions (a) and (b) only apply to equipment that is not <br /> being used to manage hazardous waste. <br /> (d) Residues that are not hazardous waste, as defined in Section <br /> 25117, including residues that are not discarded materials pursuant <br /> to subdivision (c) of Section 25124, are not subject to regulation <br /> under this chapter. <br /> 25144. (a) For purposes of this section, the following terms have <br /> the following meaning: <br /> (1) "Oil" means crude oil, or any fraction thereof, that is liquid <br /> at 60 degrees Fahrenheit and 14.7 pounds per square inch absolute <br /> pressure. "Oil" does not include any of the following, unless it is <br /> exempt from regulation under paragraph (1) of subdivision (g) of <br /> Section 279.10 of, or paragraph (5) of subdivision (g) of Section <br /> 279.10 of, Part 279 of Title 40 of the Code of Federal Regulations: <br /> (A) Spent lubricating fluids that have been removed from an engine <br /> crankcase, transmission, gearbox, or differential of an automobile, <br /> bus, truck, vessel, heavy equipment, or machinery powered by an <br /> internal combustion engine. <br /> (B) Spent industrial oils, including compressor, turbine, and <br /> bearing oil, hydraulic oil, metal-working oil, refrigeration oil, and <br /> railroad drainings. <br /> (2) "Oil-bearing materials" means any liquid or semisolid material <br /> containing oil, partially refined petroleum products, or petroleum <br /> products. "Oil-bearing materials" do not include either of the <br /> following: <br /> (A) Soil from remediation projects. <br /> (B) Contaminated groundwater that is generated at, or originating <br /> from the operation, maintenance, or cleanup of, service stations, as <br /> defined in Section 13650 of the Business and Professions Code. <br /> (3) "Oil recovery operations" means the physical separation of oil <br /> http://www.leginfo.ca.gov/cgi-bin/displaycode?section=hsc&group=25001-26000&file=25... 3/25/2004 <br />
