Transporting used oil without registering as a hazardous waste hauler, in violation <br />of Health and Safety Code 25250.23; <br />x. Transporting hazardous waste without first receiving an Identification Number and a <br />registration certificate from the Department, in violation of California Code of Regulations, title 22 <br />section 66263.17(a); <br />y. Delivering hazardous waste to a facility other than a hazardous waste facility which <br />has an appropriate and valid Hazardous Waste Facility Permit or which is authorized to receive the <br />waste, in violation of California Code of Regulations, title 22 section 66263.23(b). <br />4. Defendant, in the course of Defendant's AUTOMOTIVE PARTS ASSEMBLY activities, <br />are pursuant to Health and Safety Code section 25000 et seq., hereby permanently enjoined from: <br />a. Failing to train all new employees and annual training, including refresher courses, <br />for all employees in safety procedures in the event of a release or threatened release of a hazardous <br />material, including, but not limited to, familiarity with the plans and procedures specified in Health <br />and Safety Code section 25504(b), in violation of Health and Safety Code section 25504(c). <br />5. Defendant, in the course of Defendant's AUTOMOTIVE PARTS ASSEMBLY activities, <br />are pursuant to Business and Professions Code § 17204 hereby permanently enjoined from: <br />a. Violation of Health and Safety Code section 25100 et seq. described in paragraph <br />3 - 3y above; <br />b. Violation of Health and Safety Code section 25000 et seq. described in paragraph <br />4 - 4a above. <br />6. Defendant shall pay to Plaintiff the sum of THIRTY-TWO THOUSAND FIVE <br />HUNDRED DOLLARS ($32,500.00), as and for civil penalties, pursuant to Health and Safety Code <br />F1 <br />PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
