0 <br />1 II Paragraph 3, 4, and 5 will terminate pending the Court's ruling on the motion. Plaintiff reserves its <br />• 2 II rights to contest termination on any ground and to offer any evidence relevant to such motion, and <br />3 Defendant reserve their rights to respond on any ground and offer evidence relevant to such motion <br />4 by Plaintiff. The provisions of the Permanent Injunction in Paragraphs 3, 4, and 5 will expire and be <br />5 of no further force or effect unless the Court (upon consideration of the Parties' pleadings and <br />6 argument, if any) determines that the expiration of the provisions would not be in the interests of <br />7 justice because Defendant has not substantially complied in all material respects with the injunctive <br />8 provisions of Paragraph 3, 4, and 5. The termination of any of the Permanent Injunctive provisions of <br />9 Paragraph 3, 4, and 5 shall have no effect on Defendant's obligation to comply with the requirements <br />10 imposed by statute, regulation, ordinance, or law. <br />11 16. This Judgment shall go into effect immediately upon entry hereof.
