00 <br /> Violation #42) Failed to report releases to Department. <br /> On 2114108 unknown amount of acid spilled into a secondary containment and a decision was made not to <br /> report to the local regulating agencies. <br /> This is a violation of CCR Section 66265.77 Additional Reports. <br /> In addition to submitting the annual report and unmanifested waste reports described in sections 66265.75 <br /> and 66265.76, the owner or operator shall also report to the Department: <br /> (a)Releases, fires, and explosions as specified in section 66265.560); <br /> Provide proper notifications to all agencies listed in your notification list for every release that occur. <br /> Violation # 45, 47) Contingency Plan incomplete, No emergency coordinator <br /> Facility lacks an emergency coordinator, thus the contingency plan is incomplete. <br /> This is a violation of CCR Section 66265.55 At all times, there shall be at least one employee either on the <br /> facility premises or on call (i.e., available to respond to an emergency by reaching the facility within a <br /> short period of time) with the responsibility for coordinating all emergency response measures. This <br /> emergency coordinator shall be thoroughly familiar with all aspects of the facility's contingency plan, all <br /> operations and activities at the facility, the location and characteristics of waste handled, the location of all <br /> records within the facility, and the facility layout. In addition, this person shall have the authority to <br /> commit the resources needed to carry out the contingency plan. <br /> Immediately, appoint an emergency coordinator and include hint/her into the contingency plan. <br /> Submit proof of correction to this office within 30 days. <br /> Violation# 93) Abandoned lead acid batteries. <br /> Three lead acid batteries were found in the"bone yard" intact with the equipment that has been retired for <br /> over six months. <br /> This is a violation of CCR section 25215.2 <br /> (a) Except as provided in subdivision (b), no person shall <br /> dispose, or attempt to dispose, of a lead acid battery at a solid waste facility, or on or in any land, surface <br /> waters,watercourses, or marine waters. <br /> (b) A person may dispose of a lead acid battery at any of the following locations: <br /> (1)A facility established and operated for the purpose of recycling, or providing for the <br /> eventual recycling of, lead acid batteries, including a facility located at a solid waste <br /> facility. <br /> (2) An establishment which is a dealer pursuant to Section 25215.3. <br /> Immediately, arrangefor the lead acid batteries to be recycled, submit disposal records to this office <br /> within 30 days. <br /> 3 <br />
