In connection with the <br /> Settlement Conference, the Court requested information regarding the actual and projected costs <br /> of environmental remediation at the Property. This lettere is submitted as the Confidential <br /> Settlement Conference Statement, and provides the information requested by the Court. <br /> I. BACKGROUND <br /> The property (the "Property") that is the subject of this action is a vacant, former <br /> i gasoline station located at 1235 East Alpine Avenue, in Stockton,Kalifornia. The size of the j <br /> Property is approximately 15,000 square feet with a 1,376 square foot building. The Property <br /> was owned by Julius M. and Marjorie A. Conrady (the "Conradys") and operated as a gas <br /> station from 1956 to 19813 when the Conradys sold the Property to Smith-Burton Properties, a <br /> California limited partnership ("Smith-Burton"). American Savings and Loan Association <br /> ("ASLA") fihanced Smith-Burton's purchase together with the Conradys, who carried back a <br /> first Deed of Trust. Smith-Burton operated the "Major Mart" gas station at the Property from I <br /> 1981 to 1988. Smith-Burton defaulted on its payments to ASLA, and ASLA foreclosed on the <br /> Property in 1988.
