Ex cep t as expressly provided in th is Consent Jud gment , Wal~Mart retains all of its 11 defenses to the exerc ise of the aforementioned authority. 12 10, LIABILITY OF THE PEOPLE 13 The Pe op le shall not be liable for any injury or damage to persons or property re s ultin g 14 from acts or omiss io ns by Wal-Mart, its directors, o fficer s, employees, agents , representatives or 15 contractors, in ca rryin g out activities purs uant to thi s Consent Judgment, nor s hall the People be 16 held as a party to or guarantor of any contract entered into by Wal·Mart, it s directors, officers , 17 cmployees, agents, represe ntatives or contractors, in carrying out the requirements of this Consent 18 Judgment. 19 II. NO WAIVER m ' RIGHT TO ENFORCE 20 Th e failure of the People to enforce any pro vis ion of this Consent Jud gment sha ll neither be 21 deemed a waiver of such provision nor in any way affect the va lidity of this Conse nt Judg me nt. 22 The failure of the Peopl e to enforce any sueh provi s ion shall not preclude it from later enforcing 23 the same or any other provision of this Consent Jud gmen t , subject to Paragraph 24. Except as 24 expressly provided in this Consent Judgment Wal-Mart retains all defenses allowed by law to any 25 sueh later enforcement.
