• Pu rsuant to Paragraph 4.1, \Val-Man shall pay th e Attomey Geneidl penalties in the total amount of One <br />Mi ll io n Eight 1·lundred Twenty Five Thousand Dollars ($1,825,000.00), of which One Million Eight Hundred <br />Twenty Five 'Ibo usand Dollars ($1.825.000.00) are for penalties pursuant to Health & Safety Code sec ti on 25515.2. <br />Wal-Mart shall mak e the check payable to the "Califomia Depanment of Ju stice-L iti gation Deposit Fund." The <br />check SI1311 bear on its face the case nante ("People v. \Val -Man") and the internal docket number for thi s matt er <br />(LA200660 1034). Th e money paid to the Attorney General pursuant to Paragraph 4.1, shall be administered by th e <br />California Depanment of Ju sti ce and sha ll be used by the Environment Section oCtile Public Rights Division of the <br />Attorney General's Office, until all funds are exhausted, for any of the following purposes: (I) implementation of <br />the Attorney General's authority to protect the env ironment and natural resources of the State pursuant to <br />Government Code section 12600 et seq. and as C hief Law Officer of tile Slate of Cali fornia pursuant to Ankle V, <br />section 13 o f th e California Const itutio n; (2) enforcement of laws related to environmental protection, including. bUI <br />not limited to, Chaptcrs 6.5. 6.7 and 6.95. Division 20, oftlte California Health and Safety Code ; (3) enforcement of <br />the Unfair Compe titi o n Law, Business and Profe ss ions Code section 17200. et seq., as it relates to protect ion of the <br />environm ent and natural resources of the State of California; and (4) other environmental actions which benefit the <br />State ofCali!omia and its cili1.cns as determin ed by the Attorney Geneid\. Such funding may be used for the costs <br />of the Attorney General's investigation. Jiling fees and other court costs, payment to expert witnesses and technical <br />consultants, purchase of equipment, laboratory analyses , personnel costs , travel costS, and other costs necessary to <br />pursue environmental actions investigated or initiated by the Attorney General for th e benefit of the State of <br />California and its citizens. TIlc payment , and any interest deri ved therefrom shall so lely and exclusively augment <br />the budget o f the Attorney General's Office as it penai n s to tlte Environment Section of the Public Ri ght s Divi sio n <br />and in no manner shall supplant or cause any reduction of any po rti on of th e Attorney General's budget. <br />..
