Code Regs., tit. 22, § 66 263 .2 3) <br />44. Plaintiff reallege s paragraphs I through 43 , inclusive. <br />45. Chapter 6.5 of the Health and Safely Code pro hibits th e unauth o ri zed <br />transpo rtati o n of hazard o us waste. Sectio n 2516 3 proh ibits the tran sportati o n o f ha zardo us waste <br />without a valid regi stration from DTSC. Ca lifo rnia Code of Regulation s, title 22, section <br />66263.23(b) prohibits th e tran sportation o f haza rdo us waste to a locati o n not pcnl1ittcd or <br />otherwi se authori zed by DTSC to recei ve the waste. <br />46. Wal-Mart ha s engaged in the tran sportati o n of h azardous waste w ith o ut a valid <br />registration from DTSC, from Wal-Mart 's Ca lifo rnia Facilities to unauth o ri zc d locat ions, in <br />violatio n of Health and Safety Code section 25163 and California Code o f Regulati o ns , title 22, <br />sect ion 66263.23. <br />47 . Each act of unauthorized transportation that the Peo ple di scovered within five <br />years o f commencing thi s acti on, excl usive of any applicab le to llin g pe ri ods and th ose set forth in <br />paragraph 25 herein , subjects Wal-Mart to a separate and add itional c ivi l penalty unde r Hea lt h <br />and Safety Code sect ion 25 18 9, or a ltern ative ly under section 25189.2. <br />48.
