Plaimiffrealleges paragraphs I through 60, inclusive . <br />62. Pursuant to Bus ine ss and Profe ssions Code section 17206 , Wal·Mart is liable for <br />civil penalties for each and every sepa rate violation that accrued w ithin four years of this <br />Complaint, exclusive of any applicable tOiling peri ods and those set forth in paragraph 25 herein . <br />Wal·Mart has engaged in unlawful aC ls , omission s, and practices that constitute un fai r <br />competi ti on within th e meaning of Business and Professions Code secti o n 17200 et seq., <br />including but not lim it ed to the acts or omissions and practices a ll eged in the First throug h Fourth <br />Causes of Action, above. <br />63. By the acts described herein, Wal-Mart engaged in daily acts of unlawful and/or <br />unfair competit ion prohibi ted by 13usiness and Professions Code sections 17200-17208. Each and <br />every separate act constitutes an unl awful and/or unfair business practice. Each day that Wal - <br />Mart engaged in each separate unlawful act, omission or practice is a separate a nd d i stin c t <br />violation of Business and Professions Code section 17200. <br />64.
