Kettleman Ln. <br /> Lodi,CA 95240 <br /> Dear Inspector Veloso, <br /> This letter is in response to the Notice of Violation, dated January 21, 2016, which was issued to the <br /> subject facility. Please be advised that the following issues have been addressed: <br /> CCR 66262.11, 66262.40(c) Failed to determine if a waste is a hazardous waste or retain <br /> waste analysis on site for 3 years. Outside on the west portion [of]the facility parking lot is <br /> an open blue container, approximately three gallons in size that appears to be half full of <br /> unknown contents and oily looking liquid. A hazardous waste determination has not yet <br /> been made for this waste. Any person who generates a waste shall determine if the waste is <br /> a hazardous waste. Immediately make a hazardous waste determination for the unknown <br /> contents and oily looking liquid, and manage it according [to]the Title 22 hazardous waste <br /> regulations. Submit a statement and supporting documentation explaining how this waste <br /> was managed. Per our conversation on February 2, 2016, the container in question,which was left <br /> on site by an unknown parry,was relocated at the time of the inspection to the side of the building <br /> where the hazardous waste drums are housed. It was placed firmly between one of the drums and <br /> the exterior wall of the building to prevent it from being moved or tipped over. Thereafter, we <br /> contacted our waste vendor, Belshire Environmental Services, Inc., to schedule a pick-up of the <br /> container. However, on February 1, 2016, our Designated Operator, Laura Gomez, informed us that <br /> she was unable to find the container during her regular DO Inspection that day. Laura asked the <br /> cashier on duty, but he did not know the container's whereabouts either. Therefore, per your <br /> instructions on February 2, 2016 with regard to closure of this violation, I am relaying these <br /> circumstances with regard to the mystery waste, as it is no longer in our possession after <br /> apparently being removed by an unknown party, possibly even by the party who left it originally. As <br /> you directed, given the circumstances, we will consider this matter closed, unless you advise us <br /> otherwise. <br /> FEB 19 2016 <br />
