Please be advised that the following issue has
been reviewed and further addressed as follows:
The employee Mayra Lopez stated that the drums of hazardous waste behind the mini mart
are only checked several times a year. Containers of hazardous waste must be inspected
weekly. Correct immediately by ensuring that the containers of hazardous waste are
inspected weekly. As stated in our initial NOV Resolution Package, dated March 6, 2014,
regarding the items of alleged non-compliance noted in your February 5, 2014 inspection of this site,
our DO records indicate that all required weekly waste inspections were completed at this site for at
least 12 months prior to your inspection. But, per your email and our phone conversation on March
12, 2014, your return visit to the site on March 11, 2014 appeared to have shown that the weekly
waste inspections were not completed for a period of three(3) weeks in June 2013, and our DO
records were in error.
However, our DO made a return visit to the site on March 13, 2014, and found records showing that
the site completed all weekly waste inspections during the 12 months prior to your February 5, 2014
inspection, including during the month of June 2013. Although the site neglected to fully fill out the
"Section 9"waste inspection log for the last three weeks in June, the inspections for these weeks (as
well as all others in the 12 month period at issue)were recorded in the weekly waste inspection
portion of the "Section 5' checklist also designated for such records. Copies of all records
referenced are attached for your review and records.
