One 55-gallon blue container of waste acetone located inside the indoor paint supply mixing room was labeled <br /> as"Excluded Recyclable Material" and had a full hazardous waste label identifying it as "hazardous waste". A waste <br /> may be considered an excluded recyclable material if recycled by any of the following methods <br /> 1. used or reused as an ingredient in an industrial process to make a product if the material is not being <br /> reclaimed, <br /> 2. used or reused as a safe and effective substitute for commercial products if the material is not being <br /> reclaimed, <br /> 3. returned to the original process from which the material was generated, without first being reclaimed, if the <br /> material is returned as a substitute for raw material feedstock, and the process uses raw materials as principal <br /> feedstocks, <br /> And shall meet all of the following conditions: <br /> 1, the material is recycled and used at the same facility at which the material was generated, or by the same <br /> corporate entity, <br /> 2. the material is recycled within the applicable generator accumulation time, <br /> 3. the material is managed in accordance with all applicable requirements for generators of hazardous wastes, <br /> 4. if the material is held in a container or tank, the container or tank is labeled, marked, and placarded in <br /> accordance with the departments hazardous waste labeling, marking, and placarding requirements which are <br /> applicable to generators, except that the container or tank shall be labeled or marked clearly with the words <br /> "Excluded Recyclable Material" instead of the words"Hazardous Waste," <br /> 5. if the material is used oil, the containers, aboveground tanks, and fill pipes used to transfer oil into <br /> underground storage tanks shall also be labeled and clearly marked with the words"Used Oir', <br /> 6. the owner or operator of the business location where the material is located has a business plan that meets <br /> the following minimal requirements: emergency response plans and procedures, which specifically address the <br /> material or that meets the emergency response and contingency requirements which are applicable to generators of <br /> hazardous waste, and <br /> 7. the material shall be stored and handled in accordance with all local ordinances and codes. <br /> Immediately begin managing this material as hazardous waste or demonstrate to the EHD that the material meets <br /> the excluded recyclable material requirements (label as appropriate). <br /> This is a Class II violation. <br /> Overall Inspection Comments: <br /> An inspection checklist was provided to the facility operator on the day of inspection. The EHD has written the <br /> complete report which replaces the initial checklist. Facility inspection was initiated on 4-26-2017 and was <br /> completed on 4-27-2017. Elena Manzo and Stacy Rivera of EHD were accompanied by Tom Wise and Craig <br /> Walters at the time of facility walk through. One sample of the filter cake press material was collected on <br /> 4-27-2017 from the filter press located near the "stainless" holding tank, results were not yet available at the <br /> time of this report preparation. <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation, and any supporting <br /> paperwork, within 30 days of receiving the complete inspection report. <br /> FA0012466 PRO516115 SCO01 04!2612017 <br /> EHD 22-01 Rev.09/22/16 Page 11 of 12 'Small Quantity Hazardous Waste Generator OIR <br />
