<br />"Drip pad" means an engineered stiuctu•nsisting of a curbed, free -draining base, const of non -earthen materials and designed
<br />to convey preservative kick -back or drippage from treated wood, precipitation, and surface water run-on to an associated collection
<br />system at wood preserving plants.
<br />"Electronic device" means any electronic device that is identified as hazardous waste because it either exhibits the characteristic of
<br />toxicity as specified in article 3 of chapter 11 of this division, and/or is a listed hazardous waste as specified in article 4.1 of chapter 11 of
<br />this division. Examples of electronic devices include: computer monitors, televisions, cash registers and oscilloscopes (CRT devices),
<br />computers, computer peripherals, telephones, answering machines, radios, stereo equipment, tape players/recorders, phonographs,
<br />video cassette players/recorders, compact disc players/recorders, calculators, and some appliances. Electronic device does not mean a
<br />major appliance, as defined in Public Resources Code section 42166, or other devices which are comprised largely of metals, qualify as
<br />"scrap metal" as defined in this section, and are recycled.
<br />"Elementary neutralization unit" means a device which:
<br />(a) is used for neutralizing wastes which are hazardous wastes only because they exhibit the corrosivity characteristic defined in section
<br />66261.22, or are listed in article 4 of chapter 11 of this division onlyfor this reason; and,
<br />(b) meets the definition of tank, tank system, container, transport vehicle or vessel in this section.
<br />"Emergency permit" means a permit issued in accordance with section 66270.61.
<br />"Enclosure" means a structure that surrounds a tank or container, captures organic vapors emitted from the tank or container, and vents
<br />the captured vapors through a closed -vent system to a control device.
<br />'End-user' means (a) any person who receives a hazardous waste from an unaffiliated third party and who intends to, or does, use or
<br />reuse that waste as:
<br />(1) an ingredient in an industrial process to make a product, provided that distinct components of the material are not recovered as
<br />separate end products; or
<br />(2) a substitute for a raw material in a process that uses raw materials as principal feedstocks; or
<br />(3) a substitute for a commercial product in a particular function or application.
<br />(b) "End-user" does not include:
<br />(1) a person who receives a RCRA hazardous waste;
<br />(2) a person who receives a hazardous waste from an unaffiliated third parry and who intends to, or does, process that waste to
<br />recover usable products or regenerate that waste;
<br />(3) a person managing a material that is not a waste pursuant to Health and Safety Code section 25143.2.
<br />"EPA Acknowledgment of Consent" means the cable sent to the USEPA from the U.S. Embassy in a receiving country that
<br />acknowledges the written consent of the receiving country to accept the hazardous waste and describes the terms and conditions of the
<br />receiving countrys consent to the shipment.
<br />"EPA hazardous waste number' means the number assigned to each hazardous waste listed in article 4 of chapter 11 of this division and
<br />to each characteristic identified in article 3 of chapter 11 of this division as an EPA hazardous waste number.
<br />For the purposes of chapters 14 and 15, "Equipment" means each valve, pump, compressor, pressure relief device, sampling connection
<br />system, openFended valve or line, orflange or other connector, and any control devices or systems required by these regulations.
<br />"Equivalent method" means any testing or analytical method approved by the USEPA Administrator under 40 CFR sections 260.20 and
<br />260.21 or by the Department under section 66260.21 of this division.
<br />"Existing component" see "Existing tank system."
<br />"Existing facility'see "Existing hazardous waste management facility."
<br />"Existing hazardous waste facility'see "Existing hazardous waste management facility."
<br />"Existing hazardous waste management (HWM) facility," "Existing hazardous waste facility," or "existing facility' means a facilitywhich
<br />was in operation or for which construction commenced on or before November 19, 1980 and for which a Part A permit application has
<br />been submitted to the Department or the USEPA. A facility has commenced construction if:
<br />(a) the owner or operator has obtained the Federal, State and local approvals or permits necessaryto begin physical construction; and
<br />either
<br />(b)(1) a continuous onsite, physical construction program has begun; or •
<br />(2) the owner or operator has entered into contractual obligations, which cannot be cancelled or modified without substantial loss, for
<br />physical construction of the facilityto be completed within a reasonable time.
<br />"Existing portion" means:
