<br />"Publicly owned treatment works" or"PO eans anydevice or system used in the treatmoincluding recycling and reclamation) of
<br />municipal sewage or industrial wastes ofd nature which is owned by "State" or"municipality' (as defined by 33 U.S.C. section
<br />1362). This definition includes sewers, pipes or other conveyances only if they convey wastewater to a POTW providing treatment.
<br />"R chart (Range chart) means a control chart for evaluating the variabilitywithin a process in terms of the subgroup range R.
<br />"RCRA Characteristic" means the characteristic of ignitability, corrosivity, reactivity, or toxicityidentified in sections 66261.21,
<br />66261.22(a)(1), 66261.22(a)(2), 66261.23, and 66261.24(a)(1) of this division.
<br />"RCRA Characteristic Hazardous Waste" or "RCRA Characteristic Waste" means a hazardous waste that exhibits any of the RCRA
<br />characteristics.
<br />"RCRA hazardous waste" means all waste identified as a hazardous waste in Part 261 (commencing with section 261.1) of subchapter
<br />of chapter 1 of Title 40 of the Code of Federal Regulations and appendices thereto.
<br />"RCRA Hazardous Waste Facility Permif' or "RCRA Permit" means any hazardous waste facility permit for a facility which would be
<br />required to have a permit under 42 U.S.C. section 6925, if California's hazardous waste program were not authorized pursuant to 42
<br />U.S.C. section 6926.
<br />"RCRA Permit" See "RCRA Hazardous Waste Facility Permit
<br />"Reactive" means having properties of explosiv ty or of chemical activitywhich can be a hazard to human health or the environment.
<br />"Receiving country' means a foreign country to which a hazardous waste is sent for the purpose of treatment, storage or disposal (except
<br />short -tens storage incidental to transportation).
<br />"Reclaimed" means that a material is processed to recover a usable product, or that it is regenerated. Examples are recovery of lead
<br />values from spent batteries and regeneration of spent solvents.
<br />"Recyclable material" means a hazardous waste that is capable of being recycled, including, but not limited to, any of the following:
<br />(a) a residue;
<br />(b) a spent material, including, but not limited to, a used or spent stripping or plating solution or etchant;
<br />(c) a material that is contaminated to such an extent that it can no longer be used for the purpose for which it was originally purchased or
<br />manufactured; •
<br />(d) a byproduct listed in section 66261.31 or section 66261.32;
<br />(e) any retrograde material that has not been used, distributed or reclaimed through treatment bythe original manufacturer or owner by
<br />the later of the following dates:
<br />(1) one year after the date when the material became a retrograde material;
<br />(2) if the material has been returned to the original manufacturer, one year after the material is returned to the original manufacturer.
<br />"Recycled material" means a material which is used or reused or reclaimed.
<br />"Regional Administrator" or "USEPA Regional Administrator" means the Regional Administrator for the EPA Region in which the facility
<br />is located, or that person's designee.
<br />"Registered hazardous waste transporter" means a transporter registered with the Department to transport hazardous wastes.
<br />"Regulated Unit" means:
<br />(a) a permitted hazardous waste facility, which operates or operated:
<br />(1) any surface impoundment, waste pile, land treatment unit or landfill that receives or has received hazardous waste after July 26,
<br />1982; or
<br />(2) any surface impoundment, waste pile, land treatment unit, or landfill that ceased receiving hazardous waste byJuly 26,1982
<br />which is required to complywith the requirements of article 6 of chapter 14 of this division pursuant to section 66264.90(a);
<br />(b) an interim status hazardous waste facilitywhich operates or operated:
<br />(1) any surface impoundment, waste pile, land treatment unit, or landfill that receives or has received hazardous waste after
<br />November 19,1980; or
<br />(2) any surface impoundment, waste pile, land treatment unit, or landfill that ceased receiving hazardous waste by November 19, •
<br />1980 which is required to comply with the requirements of article 6 of chapter 15 of this division pursuant to section 66265.90(a).
<br />"Release" means:
<br />(a) Any spilling, leaking, pumping, pouring, emitting, emptying, discharging, injecting, escaping, leaching, dumping, or disposing into the
<br />environment.
