Mr. Mike Dudasko(of York Engineering), stated that all the remaining soda ash material <br /> was tested and found to be non-hazardous for pH (with readings at approximately pH 10 or pH 10.4).According to Mr. <br /> Magana, this material will be reused onsite as backfill. Mr. Magana also stated that approximately 600 tons of soda <br /> ash still remains at the facility. Any person who generates a waste shall determine if the waste is a hazardous waste. <br /> Immediately make a hazardous waste determination for the remaining soda ash, submit copies of laboratory analytical <br /> results to support your hazardous waste determination, and manage this material according the Title 22 hazardous <br /> waste regulations. Submit a statement and supporting documentation explaining how this waste will be managed. <br /> This is a minor violation. <br /> 301 CCR 66265.31 Facility not maintained to minimize the release of a hazardous waste. <br /> Observed some oily staining below a forklift, which was parked inside the facility, in the vicinity of the facility's office. <br /> Facilities shall be maintained and operated to minimize the possibility of a fire, explosion, or release of hazardous <br /> waste to air, soil, or surface water which could threaten human health or the environment. Immediately fix the <br /> equipment leak, and manage all hazardous wastes according to Title 22 hazardous waste regulations. Submit a <br /> statement and supporting documentation explaining how this violation was addressed. <br /> This is a minor violation. <br /> 401 CCR 66265.171 Failed to store hazardous waste in a container that is in good condition. <br /> One dented 55-gallon container with several saturated oily absorbent pad and some new and some oily absorbent was <br /> observed at this facility; the nature of the observed dent prevented this container from being properly closed. This <br /> container was located inside the facility in the vicinity of the facility's office. Hazardous waste shall be stored in a <br /> container that are in good condition. All hazardous wastes observed in this container were transfered into a sound <br /> container and secured (closed)as appropriate. This was corrected on site. <br /> This is a Class II violation. <br /> 403 CCR 66265.173 Failed to keep hazardous waste containers closed except when adding or removing hazardous waste. <br /> One open 55-gallon container(noted in previous violation)with several saturated oily absorbent pad and some new and <br /> some oily absorbent, was observed inside the facility in the vicinity of the facility's office. All hazardous waste <br /> containers shall be closed at all times except when adding or removing waste. All observed wastes were transfered to <br /> a container, which was properly closed at the time of inspection.
