You discussed the need for U.S. Intec to be covered by the permit, and she <br /> subsequently mailed you a copy of the permit. Based on this conversation, it is the staffs understanding <br /> that you are conducting industrial activities at your site that may be predominantly classified as the <br /> manufacturing of roofing cements and coatings. If this describes your industrial activities, then your <br /> facility is required by federal regulations to be covered under the General Permit, and failure to obtain <br /> coverage under the permit would violate the federal Clean Water Act (CWA). <br /> The NPDES storm water permit requirements are mandated in the 1972 CWA Amendments, which <br /> prohibit the discharge of any pollutants from a point source into waters of the U.S., unless it is permitted <br /> under the NPDES program. Storm water discharges that occur through discreet conveyance systems are <br /> considered point sources subject to NPDES requirements. The 1987 Amendments to the CWA <br /> mandated the U.S. Environmental Protection Agency(USEPA)to publish regulations establishing <br /> permit requirements for storm water discharges associated with industrial activities, and large and <br /> medium municipal storm sewer systems. On November 16, 1990, USEPA published these regulations <br /> which were codified in 40 CFR, Parts 122, 123 and 124. <br /> To implement these Federal Regulations, the State Board adopted a statewide general NPDES pennit for <br /> storm water discharges associated with industrial activities (General Permit) on 19 November 1991, and <br /> amended it on 17 September 1992. If an industry determines that it conducts an activity that is defined <br /> in 40 CFR, Part 122.26(b)(14)(i-xi, excluding x), it may seek coverage under the General Permit, or <br /> apply for an individual storm water permit for the appropriate Regional Water Quality Control Board. <br /> At this time, we are encouraging industries to seek coverage under the General Permit. <br /> Attached is a copy of the General Permit for your review and use. If your industrial activity is described <br /> as the manufacturing of roofing cements and coatings then your Standard Industrial Classification(SIC) <br /> code is 2952. This type of facility requires coverage under an NPDES storm water permit, however, <br /> you must determine your facility's SIC code. If this description does not describe your industrial activity, <br /> you may determine your SIC code by referring to the 1987 edition of Standard Industrial Classification <br /> Manual at your local library for additional classifications. You may then refer to Attachment 1 of the <br /> enclosed General Permit package to see if your SIC code must be covered under an NPDES storm water <br /> permit. <br />
