Metal fines generated from metal grinding are being disposed of without first determining particle size or hazardous properties. Used "Kleer Kut" (from drills and saws) is being disposed of without first determining hazardous properties. Any person who generates a waste shall determine if the waste is a hazardous waste. Immediately stop disposal of metal fines and Kleer Kut waste, make a hazardous waste determination for these wastes, and manage them according the Title 22 hazardous waste regulations. Metal particles 100 microns or smaller must be handled as hazardous waste if the metal is determined to be a hazardous waste. Submit a statement and supporting documentation explaining how these wastes were managed by June 2, 2013. 122 & 705. Hazardous waste generators shall retain copies of all manifests signed off by the destination facility on site for three years and have them readily available for review. If the generator did not receive a copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste was submitted within 60 days of the date the waste was accepted by the initial transporter, the generator shall submit a legible copy of the missing manifest, with some indication that the generator has not received confirmation of deliverV.
