The rinsewater tank on site is being disposed of without first determining hazardous properties. <br /> According to Mr. Escarsega, any spills or drips from the vehicles in the loading area are immediately <br /> rinsed into drains that flow to an underground containment sump. When determined by the facility to be <br /> just rain water, this sump water is released to the stormwater retention pond on site. If a spill was rinsed <br /> into the sump, the sump water is instead pumped into the rinsewater tank. Any person who generates a <br /> waste shall determine if the waste is a hazardous waste. Immediately stop disposal of the rinsewater <br /> waste as non-hazardous, make a hazardous waste determination for this waste, and manage it according <br /> the Title 22 hazardous waste regulations. Submit a statement and supporting documentation explaining <br /> how this waste was managed by June 6, 2014 <br /> Complete and submit a copy of the Return to Compliance Certification to the EHD by June 6, 2014 along <br /> with a statement documenting the corrective actions that have been or will be taken for each violation <br /> and any supporting paperwork. <br /> Note: The tank cleaning rinseate is being put back into the product tanks for reuse (tank capacity = 3.1 to <br /> 3.5 million gallons).
