JUN 0 6 201, <br /> ENVIRONMENTAL <br /> HEALTH DEPARTMENT <br /> reviewed and approved by the appropriate regulatory agencies — including multiple satisfactory <br /> inspections from the State of California Regional Water Quality Control Board. It is also our <br /> understanding that the Port of Stockton Environmental Department handles its off-spec fertilizer <br /> similarly and also has contracts with RSI for recovery/recycling services. Please feel free to <br /> contact Mr. Bowman directly, if you have any additional questions regarding their process. <br /> Furthermore, this very process was looked at during a previous routine inspection by San <br /> Joaquin County Environmental Health Department on June 4`h, 2010. At that time, the inspector <br /> seemed pleased with how we were managing the off-spec product. As such, this recent <br /> inspection finding has taken us by surprise. This is why we feel it is so important to add clarity <br /> to this issue and we also feel it is a good opportunity to further familiarize the San Joaquin <br /> County Environmental Health Department with our products and how we handle them <br /> responsibly. <br /> YNA takes environmental and safety compliance very serious and we appreciate the support <br /> that the San Joaquin County Environmental Health Department has provided over the years, as <br /> it does raise the standards in which all companies conduct business in the county. As <br /> requested, we have provided a signed copy of the Return to Compliance Certification for your <br /> records - even though we do not feel we were out of compliance. Given the additional details <br /> and explanation provided herein, we respectfully request that this referenced alleged violation <br /> be rescinded.
