Main Street LC <br />Stockton, CA 95203 DEC 14 2007 <br />Insection ofENVIRONMENT <br />Subject: Shell Oil ProduOcts USctobe1- Stockton Terminal 18, 2007PERMITj$ERVNCESTH <br />3515 Navy Drive, Stockton, CA <br />Dear Mr. Von Flue: <br />During your inspection of October 18, 2007 at Shell's Stockton Terminal, you noted a potential <br />deficiency of not keeping a signed copy of the TSDF manifest #000754769FLE on site for three <br />years. In Shell's response letter dated November 8, 2007 to this potential deficiency, we <br />indicated that Shell and the TSDF were awaiting a Position Paper from the DTSC concerning <br />RCRA empty drums vs California Empty Drums. At the end of February, there was a conference <br />call with Ron Daerr (Crosby & Overton), Juan Jimenez (DTSC) and Ms. Sondra Bienvenu <br />concerning this issue. At that time, Juan Jimenez indicated that he would request a position paper <br />be created. <br />On November 18, 2007, you requested that we finalize the dispensation of this drum. Therefore, <br />on 11/28/07 the D001 code for ignitability was added to the manifest by the TSDF in Section 18a <br />of the manifest and the "Designated Facility to Generator" copy was sent to Shell (see attached <br />copy).
