Box 508 <br />Stockton, California 95205 <br />Dear Mr. Henderson: <br />-- Your proposed Shell oil waste water outfall pipe can be <br />authorized under Nationwide Permit Number 7, provided you meet <br />the terms and conditions listed on the enclosed information <br />sheet, including State Water Quality Certification. <br />Also, to prevent adverse impact to the endangered Delta <br />smelt, the "in water" work must be preformed between June 1 and <br />October 15 and you must take measures to control turbidity. <br />General Condition 9 of the sheet states individual state <br />water quality certification must be obtained or waived. <br />Therefore, the proposed project is denied without prejudice and <br />cannot be authorized until either water quality certification or <br />a waiver is obtained. Water quality certification or waiver must <br />be obtained from the Regional Water Quality Control Board, 3443 <br />Routier Drive, Sacramento, California 95827. <br />The Nationwide Permit will be effective upon the receipt of <br />certification or waiver of certification and will remain in <br />effect for two years following that date or until the nationwide <br />permit is modified, reissued, or revoked, whichever comes first. <br />Work may then proceed subject to the terms and conditions of <br />certification. <br />Number 199400774 has been assigned to this project.
