Oily absorbent is being handled as non-hazardous and a hazardous waste determination has not been made. The absorbent was observed on the floor of the shop. Small amounts of absorbent were observed in the trash can with floor sweepings. Mr. Markowitz stated that the used absorbent is often sent out on the tow trucks for reuse on roadside spills, and that they are often told by CHP or the fire department to leave the absorbent piled up on the spill area when they leave. Any person who generates a waste shall determine if the waste is a hazardous waste. Immediately stop disposal of absorbent as non-hazardous, make a hazardous waste determination for the spent absorbent, and manage it according the Title 22 hazardous waste regulations. Submit a statement and supporting documentation explaining how this waste was managed. This is a minor violation.
