BOX 728 STOCKTON,CA <br /> 95201 209-948-21 <br /> San Joaquin Local Health District <br /> 1601 East Hazelton Ave. April 19, 1989 <br /> Stockton, CA 95205 <br /> Re. - Letter of 4-11-89 in reference to UGST alleged violations. <br /> On March 31, 1989 the SJLHD technician Cynthia Wagner and Charles Hinton <br /> arrived at Seibold Corporation yard to witness a tank removal along with Fire u � <br /> Inspector Al Cohen. <br /> I informed them that the tank was triple rinsed with a high pressure steam <br /> cleaner (onsite) with a 5% solution of Simple Green detergent and that <br /> material was vacuumed into a drum which was sealed and marked. I demonstrated <br /> that the tank was dry by sticking both ends with a tank gauge stick which was <br /> shown to Cynthia Wagner. Inspector Cohen asked if I had dry iced the tank. I <br /> said I had used 100 lbs. dry ice. I asked if he wished to see the receipt. He <br /> said no. He asked if I had metered the tank, I said I had, that the LEL <br /> reading was zero. He said go ahead and pull the tank. <br /> Prior to Inspector Cohen's arrival, Charles Hinton approached me and asked if <br /> our 780 Case Backhoe was big enough to pull the tank. I stated that its <br /> maximum was usually 7,500 gallon but I felt that we would not know until we <br /> actually tried to lift the tank because we weren't allowed to move the tank <br /> out of its excavation until an inspector was on site (so we wouldn't know <br /> until the inspectors were on site) . I went inside the office to get him some <br /> Pictures of prior jobs to show we indeed had lifted other tanks close to that <br /> size out of excavations. When I returned Cynthia Wagner was bent over her <br /> paperwork on the ground and said "Clever" to me and then said "Nice try.," I <br /> didn't know what she meant by this and then Charlie Hinton said "I thought you <br /> were a Christian company". Both of these people were attacking me so suddenly <br /> without explanation caused me to become angry and put me on the <br /> defensive. She asked me why the dispenser was moved to another area and I <br /> shortly replied "because Mr. Frahm asked me to" . At that time someone told me <br /> "she thought that was where the dispenser was mounted and "dispensed fuel" <br /> and I laughed, pointing to her tank closure form and said you have the <br /> location of the dispenser and piping right in front of you. She replied "you <br /> probably forgot I had it". <br /> What Ms. Wagner didn't realize was that in order to steam clean the product <br /> line it was necessary to remove the dispenser from it's base and insert the <br /> steam wand in the pipeline allowing the liquid to flow back into the tank <br /> before the tank excavation commenced. Mr. Frahm simply asked me to move the <br /> dispenser out of the way of the driveway. <br /> Absolutely no statements were made by me in any way to deceive Miss Wagner. <br /> I answered all questions asked forthright and honestly.
