Clintcn: <br /> The purpose of this letter is to explain the U.S. Environ- <br /> mental Protection Agency's (EPA) policy concerning the regulation <br /> of your product as a "dispersant and other chemical" under <br /> Subpart J of the National Contingency Plan (HCP) (40 CFR part <br /> 300) . <br /> Based on the literature and other information provided to <br /> us, it appears that your product is a sorbant• EPA does not list <br /> sorbents on the NCP Product schedule. EFA maintains the HCP <br /> Product Schedule to comply, in part, with Subpart J of the NCP, <br /> which applies to the use of "dispersants and other chemicals" <br /> (including miscellaneous oil spill control agents) ih responding <br /> to oil spills in the navigable waters of the United States. we <br /> do not interpret the meaning of either "other chemicals" or <br /> "miscellaneous oil spill control agents" to include sorbents. <br /> Because we do not list sorbents on the HCP product Schedule, <br /> responders may use such products to respond to oil spills in the <br /> navigable waters of the United States without prior approval of <br /> the on-Scene Coordinator, as Subpart J of the NCP (40 CTR 300) <br /> would require for the authorization of use of "dispersants and <br /> other chemicalr."
