The authority for these actions can be found in the California Health and Safety Code,
sections 5412, 25180.7, and.25187:1. In addition, California Health and Safety Code, section 25189.5
requires all hazardous wastes to be disposed of at an authorized, permitted disposal facility. Any
hazardous wastes left remaining at a spill location would be in violation of this section. .
Nevertheless, the time and activities performed by EHD staff must be reasonable and appropriate.'A
time and activity summary has been compiled to provide a more detailed breakdown of the EHD staff
activities and associated costs related to your spill. This document is enclosed for your review.
If you still disagree with these charges after reviewing this letter and the enclosed time and activity
summary, please let me know as I would very much like to hear your concerns. Please contact me at
(209)468-3912 to discuss this matter in more detail.
Sincerely,
Linda Turkatte, REHS
Director
c: Debra McKenzie
San Joaquin County Administrator's Office
