Before entering into his duties, the Receiver shall execute a Receiver's oath <br />and file a bond with this Court pursuant to C.C.P. § 567, from a surety <br />acceptable to this Court, in the amount of $ to ,M6 conditioned <br />upon the faithful performance Of the Receiver's duties. Upon filing of the <br />bond and oath, the Receiver shall be vested with all the powers and <br />responsibilities of a receiver as provided by law to receivers and as <br />specifically set forth herein. <br />2. After so qualifying, the Receiver shall take possession, custody and control <br />of the Receivership Estate, including but not limited to: <br />i <br />(a) The collection of any and all funds in the name of or attributable to or! <br />derived from the Property, including but not limited to, bank) <br />accounts, monies, checks, drafts, securities, letters of credit and any <br />tangible and intangible pledges as security for the letters of credit; <br />income pertaining to all: rents, and all deposits including rental and <br />construction deposits and sale deposits. <br />(b) The Receiver shall immediately acquire from the Borrowers, their) <br />members, managers, managing members, agents, officers, and any <br />rental and sales agents, the real estate, all keys, all books and records, <br />books of account, ledgers, operating statement, budgets, all banking <br />records, real estate tax bills wherever located, applicable to the <br />Property, documentation'. pertaining to all contracts, completed or in, <br />progress, all lease and/or rental agreements, leasehold interests, and) <br />all documents, records aped accounts pertaining to the development, <br />construction and operation of the Property, which shall include, but <br />-3 <br />Receivership Order <br />15492614.1 <br />
