2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14 <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />26 <br />27 <br />28 <br />Estate, such third parties shall render any performance or duties with <br />respect to the Property as directed by the Receiver. <br />(c) Bring and prosecute all ,;proper actions for the collection of accounts <br />receivable and contrac rights of the Property when due and to <br />institute ancillary proceedings, including, but not limited to, the <br />issuance of subpoenas, k conducting and participating in discovery, <br />taking depositions, the :pursuit of contempt actions, and otherwise <br />pursue all remedies available by law to ensure compliance with the <br />Receiver's authority granted herein, in this state or in other states and <br />countries as are necessary to preserve and protect the Receivership <br />Estate, and the Receiver may engage the services of other legal <br />counsel, if necessary, without further application to the Court. <br />(d) Notify the United States Post Office or other mail depository of this <br />Order and instruct it to d vert mail to the Receiver. <br />(e) Notify applicable local, state and federal taxing authorities of the <br />commencement of the receivership and communicate with said <br />authorities on behalf of the Receivership Estate. <br />( Defend all suits and actions that may be instituted against the <br />Receivership Estate or the Receiver. The Receiver shall promptly <br />provide notice to all parties of any suits filed against the Receiver <br />and/or the Receivership Estate and report said suits in its periodic <br />monthly reports to the Court as well as reporting on the status <br />thereof. <br />(g) The Receiver shall have I he power and authority to sell all or any part <br />of the Property of the Re eivership Estate, free and clear of liens and <br />monetary encumbrances gelating to the Property. The Receiver shall <br />notify any prospective purchaser of the Property of the Deed prior to <br />entering into any agreement to sell the Property, and any such <br />-9 <br />Receivershi,p Order <br />15492614.1 <br />
