IV. BACKGROUND:
Dopaco notified the U.S. Environmental Protection Agency (U.S. EPA) in 1987
that they were a hazardous waste generator. The facility has been located at 4545
Quantas Lane, Stockton, since November, 1987. From 1981 to 1987, the facility
was located at 800 W. Church Street, Stockton.
On March 28, 19901 this facility had an accidental spillage of cleaning solvent and
printing pigments. A truck upset a 55 gallon drum of waste solvents and pigments
causing it to rupture and drain the contents into the storm drain. William Snavely,
R.E.H.S. of FHS-EHD, investigated the complaint (#90-0484) and filed a
Proposition 65 report (#90-075). The waste was pumped out of the storm drain
by I.T. Services of Manteca, CA, under direction from the City of Stockton
Municipal Utilities District.
On October 10, 1990, PHS-EHD conducted a routine hazardous waste generator
inspection. As a result of this inspection, violations of the California Code of
Regulations were identified, including the presence of unlabelled drums containing
hazardous waste, an unattended open drum containing hazardous waste, and the
absence of health and safety training records.
On November 22, 1991, PHS-EHD conducted a routine hazardous waste
generator inspection and a follow up inspection was completed on September 22,
1992. No violations of Title 22, California Code of Regulations were noted. The
follow up inspection was needed to verify the volume of hazardous waste
generated during these time periods.
The U.S. EPA conducted a Resource, Conservation, and Recovery Act (RCRA)
Compliance inspection on May 20, 1992 to determine Dopaco's compliance with
hazardous waste regulations. No RCRA violations were observed at the time of
this inspection. Because no RCRA wastes are generated, the U.S. EPA #CAD
982415804 was deactivated and Dopaco was issued a new CAL #921143622.
On August 6, 1994, PHS-EHD conducted a routine hazardous waste generator
inspection. A follow up sampling inspection was conducted to verify proper waste
classification on August 17, 1994 and several violations of the California Code of
regulations were noted. Hazardous waste had not been properly characterized,
hazardous waste had been transported offsite without the use of a manifest,
hazardous waste was disposed of improperly, hazardous waste was not labeled
properly, and adequate decontamination equipment was lacking in the hazardous
waste storage area.
2
