Box 388 <br /> Stockton, Ca 95201-0388 <br /> Dear Sir: <br /> Reference is made to San Joaquin County invoice # 30609 in the amount of <br /> $2,040.00 for account #3715 and facility # 4062. 1 am being charged, on this <br /> invoice, for yearly tank fees from 1991 to 1996 and 100% penalties for the same <br /> period. I am seeking relief or a reduction of these fees and penalties listed <br /> on this invoice for the following reasons. It is true that I am the property <br /> owner and have been since 1946. 1 owned and operated Vogue Cleaners at <br /> 2315 N. California St. for many years until my retirement in 1973. At the time <br /> of my retirement I had never used the tank in question and had no knowledge <br /> of its existence. I have had the property leased to several people over the <br /> years and it has always been operated as a dry cleaners. The tank, as for as I <br /> know, has never been used by any of my tenants since my retirement. The <br /> location of the tank, at the back corner of the storage shed at the rear of my <br /> property and the fact that there never was a pump attached to it attribute to <br /> my not knowing that it was there. <br /> I am not happy about having to pay fees on a tank I didn't know existed <br /> but I realize my responsibilities. However, I don't think that I should be <br /> penalized in addition to the fees. I am retired and on a fixed income and am <br /> looking to have to spend more money on site investigation in the near future. <br /> Fining me for not paying yearly fees that didn't come into play until 11 years <br /> after I had retired and away from the business, doesn't seem fair to me. I <br /> have applied to the State Underground Storage Tank Cleanup Fund for <br /> assistance and I know that I will be responsible for at least another <br /> $10,000.00. <br />
