Foley
Program Coordinator
Environmental Health Department
San Joaquin County
600 East Main Street
Stockton, CA 95202
RE: 3480 E. Carpenter Road(Roto Rooter)
Ms. Foley:
I am writing this letter to inform you that I have reviewed our file and was unable to locate
enough information to proceed with a prosecution at this time.' It appears that there are possibly
two unlawfully abandoned UST's existing on this site or that there were two unlawfully
abandoned UST's on this site. When time allows, perhaps your staff could follow up with a site
inspection and prepare a referral outlining current site status. Once I have that information, I will
then contact the owners of the tanks and the owners of the facility and try to bring the site into
compliance with Chapter 6.7 and Chapter 6.75.
It is my understanding that the site was not brought into compliance in 2000 and that there may
very well be outstanding Chapter 6.7 issues at this time. I assure you that timely and efficient
prosecution of these types of violations remains a major focus of the Environmental Prosecutions
Unit and you will be provided with our strongest efforts once this file has been updated.
If you have any questions, please do not hesitate to contact me. I may be reached at
209.468.2470 or via e-mail at david.irey@sjcda.org.
Sincerely,
eCEOF DIS ATTORNEY
ty istrict Attorney
' It is my understanding that during the time period between late 1999 and early 2000 I requested all
information available related to UST's that had failed to meet the 1998 deadlines. Additionally,I requested this
information be forwarded without the standard"Request for Legal Action". I had hoped to get to all of these files,
however, staffing levels precluded this office from timely handling all EHD's 1998 upgrade issues.
