A routine inspection was conducted on March <br /> 13 , 1997 . At that time you indicated that the tank was no longer <br /> being used as a part of your operation. I recommended that you <br /> have the tank removed. The inspection report indicated that you <br /> would submit an application to close the tank. The application to <br /> close was never submitted to PHS-EHD. Title 23 Section 2645 CCR <br /> requires the tank to be monitored. The monitoring program must be <br /> implemented regardless to weather the tank is in use or not . The <br /> section requires that the tank be removed from service for 48-72 <br /> hours, each week, for tank gauging and an annual tightness test <br /> conducted. PHS-EHD has not received any annual tightness test <br /> results for this facility. This facility has failed to obtain a <br /> permit to operate as required by Health and Safety Code Section <br /> 25284 . The facility must conduct a tightness test and provide <br /> proof of monitoring or submit an application to close the tank. <br /> This must be completed within 30 days of receipt of this letter. <br /> Failure to comply with this letter may result in further legal <br /> action by this Department . <br /> IF you have any further questions regarding this matter, please <br /> contact me at 468-0332 . <br /> Karen Furst, M.D. , M.P.H. <br /> Health Officer <br /> �� <br /> Robert McClellon, Sr. R.E.H.S. <br /> Environmental Health Division <br /> A Division of San Joaquin County Health Care Services <br />
