<br /> I . CASE SUMMARY
<br /> On March 30, 1994, an inspection for Underground
<br /> Storage Tank (UST) compliance was performed by Letitia
<br /> Briggs, Senior Registered Environmental Health
<br /> Specialist (R.E.H.S. ) , Public Health Services-
<br /> Environmental Health Division (PHS-EHD) at 2122 S.
<br /> Airport Way, Stockton, CA. The inspection was followed
<br /> by an April 4, 1994 , file review. Both the inspection
<br /> and file review confirmed violations of the California
<br /> Health and Safety Code, Division 20, Chapter 6. 7,
<br /> Sections 25280 through 25299. 7 at Ralph's Square, 2122
<br /> S. Airport Way, Stockton, CA.
<br /> Inspections have been performed to inform and assist
<br /> the facility at 2122 S. Airport Way, achieve compliance
<br /> with UST regulations including: (1) Site evaluation on
<br /> November 1987 by Bill Snavely, Senior R.E.H.S, (2)
<br /> Routine inspection January 1, 1991, by Charles Hunt,
<br /> Senior R.E.H.S. , (3) Routine inspection June 28 , 1993 ,
<br /> by Eleanor Ratliff, Senior R.E.H.S. , (4) Inspection
<br /> March 30, 1994 , by Letitia Briggs, Senior R.E.H.S.
<br /> An office hearing was scheduled for Mr. White, owner,
<br /> and the Ralph's Square operator on July 12, 1994 . The
<br /> hearing was canceled and rescheduled for July 20, 1994 ,
<br /> when PHS-EHD learned Mr. White would be out of town on
<br /> the July 12. PHS-EHD rescheduled and sent an office
<br /> hearing letter for July 20, 1994, by certified
<br /> delivery, return receipt requested. The signed
<br /> certified delivery, return receipt was received by PHS-
<br /> EHD on July 19, 1994. However, no one appeared for the
